RELEASE AND WAIVER OF LIABILITY
ASSUMPTION OF RISK AND INDEMNITY AGREEMENT
ATTENTION: READ THIS DOCUMENT CAREFULLY! THIS IS A RELEASE OF LIABILITY AND EXPRESS ASSUMPTION OF RISK AGREEMENT. THE FOLLOWING RELEASE WILL APPLY TO ALL EVENTS AND ACTIVITIES RELATED TO THE CONTEST OR EVENT DESCRIBED BELOW.
IN CONSIDERATION of being permitted to compete in the Contest (as described below) and/or participate in any way in the Event(s) (as described below), or being permitted to enter for any purpose any premises (the Premises) of any Released Party (as defined below), or being permitted to use any form of transportation organized by any Released Party (the Transportation) in connection with the Event, each of the undersigned, for himself/herself, his/her personal representatives, heirs and next of kin:
1.Acknowledges, agrees, represents and warrants that the undersigned has attained at least the age of 18, is of sound mind, is participating in the Contest and/or Event described below which is given by Sunburst Media Louisiana LLC d/b/a KCIL(FM) – 107.5 FM, KJIN(AM) – 1490 AM, KXOR(FM) – 106.3 FM and KMYO(FM) – 96.7 FM, and understands that Sunburst Media Louisiana LLC (the Company) does not warrant or guarantee the safety of the Premises, the Event nor any Transportation provided or related thereto. The undersigned agrees and acknowledges that he/she takes full responsibility to investigate the safety in this matter and further acknowledges, agrees, and represents he/she has or will immediately upon entering any of such Premises or modes of Transportation, and/or upon participation in the Event, and will continuously thereafter, inspect the Premises, the mode of Transportation and/or the arrangements for the Event, which he/she enters and he/she further agrees and warrants that, if at any time, he/she is in or about the Premises and/or mode of Transportation and/or the participation in the Event and he/she feels anything to be unsafe, he/she will immediately advise the Company representatives of such and will leave the Premises, the mode of Transportation, and/or refuse to participate further in the Event(s).
2.Hereby releases, waives, discharges and covenants not to sue the Company, any of its affiliates, officers, directors, employees, agents, insurers, promoters, participants, sponsors, advertisers, vehicle owners, drivers, any persons in or about the Premises, owners, lessees or licensee of any Premises used to conduct the Event(s), premises and event inspectors, surveyors, underwriters, consultants and others who give recommendations, directions, or instructions or engage in risk evaluation or loss control activities regarding the Premises or Event(s) and each of them, their directors, officers, agents and employees, all for the purposes herein referred to as Releasees, from any and all liability, on any legal theory to the undersigned, his/her personal representatives, assigns, heirs and next of kin for any and all loss or damage, and any claims or demands therefore on account of injury to the person or property of the undersigned or resulting in death of the undersigned arising out of or related to the Event(s), whether caused, in whole or in part by the sole or concurrent negligence or wrongdoing of the Releasees or otherwise and the undersigned hereby specifically assumes all such risks fully and completely.
3.Hereby agrees to indemnify and save and hold harmless the Releasees and each of them from any loss, liability damage, or cost (including attorneys fees and court costs), they may incur arising out of or related to the Contest or the Event(s) whether caused, in whole or in part by the sole or concurrent negligence or wrongdoing of the Releasees or otherwise and the undersigned agrees to defend any claim or suit which may arise from the foregoing and to pay all attorneys fees and costs thereof.

3.Hereby agrees to indemnify and save and hold harmless the Releasees and each of them from any loss, liability damage, or cost (including attorneys fees and court costs), they may incur arising out of or related to the Contest or the Event(s) whether caused, in whole or in part by the sole or concurrent negligence or wrongdoing of the Releasees or otherwise and the undersigned agrees to defend any claim or suit which may arise from the foregoing and to pay all attorneys fees and costs thereof.
4.Hereby assumes full responsibility for any risk of bodily injury, death or property damage arising out of or related to the Contest or the Event(s) whether caused by the negligence or wrongdoing of Releasees or otherwise.
5.Hereby acknowledges that the activities of the Contest or the Event(s) may be very dangerous and involve the risk of serious injury and/or death and/or property damage. Each of the undersigned also expressly acknowledges that injuries received may be compounded or increased by negligent rescue operations or procedures of the Releasees.
6.Hereby agrees that this Release and Waiver of Liability, Assumption of Risk and Indemnity Agreement extends to all acts of negligence or wrongdoing by the Releasees, including negligent rescue operations and is intended to be as broad and inclusive as is permitted by the laws of the State in which the Event(s) is/are conducted and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
Winners can only win 1 time every 30 days – Birthday Cakes MUST be picked up the same day – *All other prizes must be picked up within two weeks at the KCIL-FM studios Monday through Friday 9AM to 4PM at 120 Prevost Drive in Houma.
The undersigned participant, for him/herself and his/her heirs, executors, successors and assigns hereby releases, discharges and covenants not to sue KCIL 107.5 FM operated by Sunburst Media Louisiana LLC or any of its officers, agents or employees, as a result of death, or any personal injury to property damage suffered by him/her while participation in the contest, and agrees to hold harmless each of them from any loss, liability, damage or cost he/she may incur due to his/her participation in contest, prize or event.
The undersigned hereby assumes full responsibility for any risk of bodily injury, death or property damage due to any association with, or related in any way directly or indirectly to the contest, prize or event.
The undersigned expressly acknowledges the existence of, and agrees to assume, any and all risk of danger, including risk of injury and/or death or property damage/loss. The undersigned further expressly agrees that this release and discharge agreement is intended to be as broad and inclusive as is permitted by law.
The undersigned has read and voluntarily signs this release and discharge of liability agreement, and further agrees that no oral representation, statements, apart from the foregoing written agreements have been made.
The undersigned hereby grants KCIL 107.5 FM permission to use their name and recorded responses/and or image in on-air announcements in conjunction with this contest and general station promotional activity.
